The first court appearance for Tyler James Robinson opened in Utah County with Judge Graf presiding. He reminded attendees that electronic devices were not permitted and disruptions would lead to removal. Robinson, charged with the murder of Charlie Kirk, confirmed his identity before the court addressed the appointment of counsel. After reviewing his financial declaration, Judge Graf found him indigent and provisionally assigned death penalty-qualified attorneys to represent him. Those attorneys must file their qualifications before the waiver hearing set for September 29.
The court informed Robinson of his right to counsel and his right against self-incrimination. He was ordered to remain in custody without bail. Prosecutor Chad Grunander appeared with the trial team and secured a pre-trial protective order for Kirk’s widow, Erica Kirk. The judge signed the order. Prosecutors then confirmed they had filed notice of intent to seek the death penalty and said discovery materials would be handed over to the defense under Rule 16.
The judge proceeded to read the charges. Robinson faces aggravated murder, a capital felony that carries the possibility of the death penalty or life without parole. Prosecutors allege Robinson targeted Kirk because of his political expression and that the killing occurred in the presence of children, both of which serve as aggravating factors. A second count charges him with felony discharge of a firearm causing serious bodily injury, also enhanced for targeting political expression and the presence of children.
The charges continue with two counts of obstruction of justice for concealing the rifle and destroying clothing linked to the shooting. Robinson also faces two counts of witness tampering, accused of directing his roommate to delete incriminating messages and remain silent if approached by police. The final charge is committing a violent offense in the presence of a child, a Class A misdemeanor. Each enhancement elevates the severity of sentencing exposure.
The hearing concluded with the judge confirming the case will return on September 29 for a waiver hearing, to be held via WebEx. Robinson remains held without bail, and the death penalty notice now formally defines the stakes of the prosecution.
